Why wasn’t I charged yet? (blood draw DUI)
DUI cases with a blood draw take longer to initially charge. The blood specimen is sent to the Washington State Patrol Tox lab for analysis, this usually takes 4 – 6 weeks. The test results are then sent back to the officer. The Officer then forwards to the prosecutor the police report and blood test results for review for charges. The whole process can take 6-12 weeks. -
Can I get charged with a DUI with a breath test under .08?
Yes, you do not have to be over .08 to be charged with DUI in Washington State. The prosecutor can still charge you under the “affected by”prong of the DUI statute. -
Is the Ignition Interlock Device Required on a Drug DUI?
Yes. The Ignition Interlock Device (IID) is still required even if your DUI has nothing to do with alcohol. -
Does it matter whether I request a DOL Hearing online or by mail?
No. I do not think it makes a difference anymore. In the old days there was a small chance the Department of Licensing (DOL) would misplace or not process the request properly. Now, it rarely happens – so whatever is easier for you. Just make sure to request a hearing. -
What did my DUI case end up in Federal Court?
Your DUI case ended up in Federal Court because your DUI arrest must have taken place on “Federal’ property. For example, you were arrested in a national park or on a military base among others. -
What is the Statutue of Limitations for Personal Injury Claims in Washington?
