How many days to my license is suspended after my DUI arrest?
30 days from the date of arrest – if you do nothing. If you request a Department of Licensing (DOL) Hearing within seven (7) calendar days – this time period is extended until the DOL Hearing Officer issues a decision in your DOL case. You usually will receive ten (10) days notice or so before the suspension takes effect after a ruling.

Is it worth paying $375 for the DOL Hearing?
Yes. Even though your chances of success are slim (see previous post) it is always worth requesting a Department of Licensing (DOL) hearing. You just never know what may happen. Worst case is you get a preview of the prosecutors case and often way before the DUI criminal case is filed. I use the hearing for discovery proposes. In other words, to try to find out as much about the client’s DUI case as possible. (review the police report, breath test evidence, talk to witnesses etc.)

What are my chances of success in the DUI DOL Hearing?
Roughly 1 in 4. Twenty-five (25%) or so. Obviously, this varies somewhat depending on the Department of Licensing (DOL) Hearing Officer.

Will I need SR-22 Insurance because of my DUI conviction?
Yes. In most cases. SR-22 High Risk Insurance is required for three (3) years on a DUI administrative suspension and/or revocation or as a result of a DUI, Physical Control or Reckless Driving conviction. To avoid SR-22 insurance you would have to be successful at the Department of Licensing (DOL) administrative hearing and have the DUI or Physical Control charge either dismissed/reduced to negligent driving or reckless endangerment. The only other exception would be if you entered a deferred prosecution and you did not refuse the breath test or were successful at the DOL hearing.

How long does it take to get a Department of Licensing (DOL) ruling after Hearing?
Trypically 2-4 weeks. However, this can vary by Hearing Officer. I have had some recently as short as eight (8) days. -
What happens if I do not request a Department of Licensing (DOL) Hearing fro my DUI arrest?
Your Washington State driver’s license or privilege to drive in the State of Washington (if out of State License) will be suspended or revoked 60 days from the date of your arrest for DUI or Physical Control. -

You have 20 Calender days to apply for a Department of Licensing (DOL) Hearing. Remember it is not business or Court days – but actual calender days from the date of your arrest for DUI or Physcial Control.

Can I postpone my Washington Department of Licensing Hearing?
Yes. You can continue or postpone the Washington State Department of Licensing (DOL) Administrative Hearing one (1) time – no questions asked. (more than once usually requires an emergency situation.) You will have to fill out an Administrative Hearing reschedule form available on the DOL website. See Link. Reschedule Hearing. You call DOL first to reschedule hearing and then fax the completed form to DOL.
